Terms and Conditions for Toshiba Cashback 2009 Promotion (Selected Toshiba Laptop Models Only)
Promotion Period: 1st April 2009 - 30th April 2009
End-users can claim Cashback in this promotion on a maximum of 25 qualifying laptops purchased per end-user per calendar month.
This promotion is not open to employees of Toshiba or distributors, resellers, e-sellers, retailers or any 3rd party suppliers of Toshiba laptops to end-users, their employees, families or anyone connected professionally with the promotion.

The promotion is only open to end-user purchases of qualifying Toshiba laptops from resellers in the promotion period - a list of qualifying laptops with relevant refund amounts can be found at: www.toshibacashback.com/laptops.

To be eligible for this promotion, end-users must purchase a qualifying Toshiba
laptop.

This offer is limited to 25 machines per customer per calendar month.

Purchases of refurbished or reconditioned Toshiba laptops are not
included in this promotion.

This promotion is open to residents of the United Kingdom and the
Republic of Ireland only.

This promotion is not open to employees of Toshiba or distributors,
resellers, e-sellers, retailers or any 3rd party suppliers of Toshiba
laptops to end-users, their employees, families or anyone connected
professionally with the promotion.

In order to qualify for the Toshiba Cashback 2009 promotion,
purchasers must register their purchase on the promotional website
www.toshibacashback.com between thirty (30) and sixty (60) days after
the date of invoice of their laptop (Cash Back claims cannot be
accepted at any other time) and must submit their application for a
refund within 60 days of purchase.

All registrations & applications must be received no later than 1st
July 2009.

To qualify for the promotion you must send in the following between

Registration Certificate made by you between thirty (30) and sixty
(60) days after the date of invoice of their laptop (Cash Back

Photocopied proof of purchase and Toshiba Cashback 2009 Registration
Certificate will not be accepted.

Proof of purchase will be returned to you but we suggest that you take a
photocopy of your documents and keep them for your reference before
sending them. We also recommend you send your application via recorded
delivery.

Provided all applicable terms are met, a refund for the relevant amount
for the qualifying promoted product purchased will be sent to you within
28 days of receipt of your application.

All cheques will be made payable to organisation
responsible for the purchase of the laptop.

Applications will be screened for validity, to ensure that:

only bona fide end-users are claiming their cashback |

distributors, resellers, e-sellers, retailers or any 3rd party
suppliers of Toshiba laptops to end-users are not claiming cashback

Leased laptops do not qualify for this promotion unless registered and
claimed by the leasing company directly.

In the event of a product failing and being replaced in the warranty
period, the replacement product will not qualify for this promotion.

Proof of posting will not be accepted as proof of receipt.

The offer is limited to 25 machines per customer per calendar month,
applications will be accepted for single or multiple purchases and
multiple applications may be made, providing the correct registration
has been made, and must not exceed 25 machines. The offer is limited to
one Cashback per machine.

Toshiba will be responsible for the cost of sending the refund to you,
but you will be responsible for all other costs associated with the
refund process. Toshiba reserves the right to withhold the payment if
there is a cause to believe a refund is requested otherwise than in
accordance with these conditions.

The end-user making a claim will be responsible for any tax implications
there may be.

This refund offer does not affect your
statutory rights.

Toshiba cannot accept responsibility for
claims lost, delayed or damaged in the post.

Toshiba does not warrant that your use of or access to the registration
site will be uninterrupted by error or virus free nor shall it or its
licensors have any liability for damaged caused by hostile software
which may affect or infect your computer equipment or property as a
result of your use or browsing of this site.

Registering your standard laptop warranty or any other Toshiba promotion
is not accepted as registering for the Toshiba Cashback 2009 promotion.
Toshiba will not accept liability if the online registration for the
promotion at www.toshibacashback.com is not completed between thirty
(30) and sixty (60) days after the date of invoice of their laptop (Cash
Back claims cannot be accepted at any other time).

As part of applying for and receiving Cashback, it is the responsibility
of VAT registered companies to consider and act upon the following
statement from HMRC:

Toshiba reserve the right to amend / change the
cash back value and qualifying models from one promotional period to
another.
"If you are VAT registered and you receive 'Casback' this reduces the
taxable value of your purchase and you must reduce your input tax
accordingly. HMRC will assess for over-claimed input tax where these
adjustments are not made."
